: * The applicant shall schedule an inspection with a City Engineering Inspector by calling 253-435-3650 at least 48 hours in advance of parklet occupancy. * The applicant shall schedule an inspection with a City Engineering Inspector by calling 253-435-3650 after installing the commercial equipment, structures, and furniture in the parklet to determine if there are any site visibility impacts for vehicular or pedestrian traffic. Upon inspection, the City reserves the right to require the applicant to remove any site obstructions immediately from the parklet. * The applicant shall adhere and comply to all outdoor seating and service requirements as defined by the Washington State COVID-19 Reopening Guidance for Businesses and Workers, Governor Inslee’s Proclamations, the Washington State Department of Health, the Tacoma Pierce County Health Department, the Washington State Liquor and Cannabis Control Board, and all other jurisdictional agencies. * The area of the proposed parklet, including the City-provided traffic barriers, shall not extend beyond the applicant's business' street frontage unless written authorization is submitted by the adjacent business or property owner whose street frontage is to be impacted. * Music shall not be played at a volume that disrupts neighboring businesses or the public. * All commercial equipment, structures, and furniture shall be located within the perimeter of the City-provided traffic barriers or parklet. * The City reserves the right to require the applicant to remove the temporary tent or parklet immediately and without notice. * The City may install water barriers on either side of the tent within the City right-of-way. Follow approved site plan. Inspection time performed during a regular 8 hour day Monday - Friday 7:00 am - 5:00 pm is included in the permit fee. Inspection time performed outside of those hours are charged to the permit holder at a rate of $130 per hour with a three hour minimum. 1. Applicant/contractor shall notify the City within 48 hours prior to work start date and also to close the permit when all work and restoration are complete and ready for final inspection at Inspection Request Line: 1-877-232-6456 or https://secure.puyallupwa.gov. 2. I agree to have the approved permit on site at all times. 3. UTILITY INSPECTIONS ARE REQUIRED PRIOR TO BACKFILLING. 4. No work shall be done in or on the public right of way without a licensed and bonded contractor first obtaining a right of way permit. 5. I agree to keep the existing right of way free of debris and dirt. 6. I agree to call the Utility Notification Center at 1-800-424-5555 before beginning any excavation. Call before you dig, it's the law. 7. I agree to adhere to the approved Traffic Control Plan. 8. I agree to perform all work in accordance with City's Standards. Any curb, gutter or sidewalk broken now or during construction shall be removed and replaced. 9. I hereby acknowledge that I have read and understand the contents of this permit and I hereby state that the information I have supplied is true and correct. 10. TO SCHEDULE INSPECTIONS, CHECK PERMIT STATUS OR TO MAKE PAYMENTS ON THE CITY WEB SITE VISIT https://secure.cityofpuyallup.org/ Indemnification / Hold Harmless The Permittee shall defend, indemnify and hold the Public Entity, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with activities or operations performed by the Permittee or on the Permittee's behalf out of issuance of this Permit, except for injuries and damages caused by the sole negligence of the Public Entity. However, should a court of competent jurisdiction determine that RCW 4.24.115 applies to this Permit, then the Permittee agrees to defend, indemnify and hold the Public Entity, its officers, officials, employees and volunteers harmless to the maximum extent permitted thereunder. It is further specifically and expressly understood that the indemnification provided herein constitutes the Permittee's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement.
Pipeline Notfication Rcw 19.122.033 Resolved Engineering Division Standard Conditions
: Effective January 1, 2013 RCW 19.122 Before conducting any construction or excavation within 100 feet of a right-of-way or utility easement containing a transmission pipeline a person must notify the pipeline companies of the scheduled excavation through the one-number locator service 811. Notification must occur in a window of not less than 2 business days but not more than 10 business days before beginning the excavation. If a transmission pipeline company is notified that excavation work will occur near a pipeline, a representative of the company must consult with the excavator on-site prior to excavation.
