: The subject property has been classified as a contaminated site by the Tacoma Pierce County Health Department (TPCHD) and must be remediated per Washington Administrative Code Title 173. It is the applicant’s responsibility to coordinate cleanup with TPCHD by contacting TPCHD’s Rob Olsen at rolsen@tpchd.org. Demolition Standard Conditions Open Engineering Division Standard Conditions
: ** It is unknown how the site will be stabilized after the demo, but it will be a condition of this permit prior to final approval ** ** SEDIMENT CONTROL AND EROSION PROCEDURES SHALL BE PRACTICED TO ELIMINATE AND PREVENT OFF SITE DAMAGE. STORMWATER RUNOFF ORIGINATING UPSTREAM OF EXPOSED AREAS SHALL BE CONTROLLED TO REDUCE EROSION AND SEDIMENT LOSS DURING THE PERIOD OF EXPOSURE. * I agree to call the Utility Notification Center at 1-800-424-5555 (811) before beginning any excavation. Call before you dig, it's the law. * I agree to cut and cap the sanitary side sewer at the property line while under the supervision of a City Inspector. The existing side sewer shall not be reused. The applicant is responsible to call the inspection line at 1-877-232-6456, code #2925 to schedule inspections. Utility inspections are required PRIOR to backfilling. The City Water Division shall perform the water meter removal. Contact Jeff Daschofsky at 253-841-5512 to schedule the water meter or service removal. * I agree to call the inspection line at 253-445-4795 or 253-445-5092 to schedule a building final inspection. Enter action code 9800 when prompted for Building Inspection Final. I hereby acknowledge that I have read and understand the contents of this permit and I hereby state that the information I have supplied is true and correct. Indemnification / Hold Harmless The Permittee shall defend, indemnify and hold the Public Entity, its officers, officials, employees and volunteers harmless from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or in connection with activities or operations performed by the Permittee or on the Permittee's behalf out of issuance of this Permit, except for injuries and damages caused by the sole negligence of the Public Entity. However, should a court of competent jurisdiction determine that RCW 4.24.115 applies to this Permit, then the Permittee agrees to defend, indemnify and hold the Public Entity, its officers, officials, employees and volunteers harmless to the maximum extent permitted thereunder. It is further specifically and expressly understood that the indemnification provided herein constitutes the Permittee's waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purposes of this indemnification. This waiver has been mutually negotiated by the parties. The provisions of this section shall survive the expiration or termination of this Agreement.
Pipeline Notfication Rcw 19.122.033 Open Engineering Division Standard Conditions
: Effective January 1, 2013 RCW 19.122 Before conducting any construction or excavation within 100 feet of a right-of-way or utility easement containing a transmission pipeline a person must notify the pipeline companies of the scheduled excavation through the one-number locator service 811. Notification must occur in a window of not less than 2 business days but not more than 10 business days before beginning the excavation. If a transmission pipeline company is notified that excavation work will occur near a pipeline, a representative of the company must consult with the excavator on-site prior to excavation.
Miscellaneous Planning Condition Open Planning Division Standard Conditions
: SEPA Condition (#P-21-0057): The project site is a known contaminated site and is within the vicinity of known contaminated sites. The City’s remediation consultant is awaiting a written opinion from the Dept. of Ecology regarding the contamination status of the site. The request for an opinion from the Dept. of Ecology Toxics Cleanup Program was submitted on 7/9/2021. Once received, the applicant shall work with the responsible party to comply with all requirements for further clean up or monitoring (if imposed) from the Dept. of Ecology. No permits for construction will be issued for this site until the Dept. of Ecology has issued a No Further Action determination for this contaminated site. Demolition of the existing building on the site can proceed before a No Further Action determination is issued with the following condition; there shall be no disturbance to the foundation slab and existing hard surfaces (existing seal) over the contaminated soils.
