DRAINAGE FACILITIES. The proposed storm water management system shall conform to the general design criteria set forth below and specific development standards referenced in PMC 19.12.020 and in the current version of the Stormwater Management Manual for Western Washington as most recently adopted by the city for city use: (a) No commercial development shall be approved which does not make adequate provision for storm or flood water runoff, and for low impact development principles; (b) All storm water systems shall be separate and independent from sanitary sewer systems; (c) Storm water systems may consist of a combination of low impact development, natural drainage systems, curb and gutters, underground piping, water quality treatment facilities, and detention/retention facilities. Preference is given to low impact development, retention and use of natural drainage systems whenever possible; (d) Storm water systems shall be designed to maintain historical flows necessary for the preservation of wetlands, ponds, streams, or other critical areas. Separate infrastructure may be approved for use in collecting and discharging roof runoff and spring/seep water to critical areas to assist in maintaining historical flows. In no instance shall road or yard runoff be permitted to be discharged to critical areas without appropriate pretreatment. Storm water systems shall be sited and designed to avoid potential adverse impacts to steep slopes, aquifer recharge areas, wetlands, or other identified critical areas; (e) Adequate biofiltration facilities shall be provided to reduce siltation and water quality impacts; (f) All public storm water facilities shall be located either in a public road right-of-way, or in a separate dedicated tract of appropriate width and improved to the standards set forth in the most recent city engineering standards and specifications manual; (g) Low impact development, retention, and use of natural drainage systems is required wherever feasible. Drainage ways shall be established and delineated by easement of adequate width which conforms substantially to the lines of the watercourse, and shall be maintained in an open vegetated channel.

SEPA Mitigation Measure per SEPA MDNS 1/9/2024 Water: The use of the site for vactor truck business requires large amounts of water to be filled into each truck for proper operations. Past filling of trucks from un-approved sources (non-conforming taps on public hydrants at 2412 Inter Ave) has resulted in flooding in the roadway of Inter Ave. Required mitigation shall include: a. No water services shall be installed within 10 feet of backflow prevention device or water lines. b. Filling trucks from the public hydrant is not permitted.

SEPA Mitigation Measure per SEPA MDNS 1/9/2024 Environmental Health: a. The use of the site for a vactor truck business, which involves the use of a vacuum truck that has a pump designed to pneumatically suck liquids, sludges, slurries, or the like from a location into the tank of the truck, could feasibly result in environmental health impacts such as contamination of surface waters from liquids contained within the tank if not properly mitigated. The following mitigation shall be required unless or until onsite facilities are approved: i. Decanting of any materials contained within the vactor trucks shall be performed offsite at facilities licensed by a local Department of Health. ii. Vactor trucks shall be dumped and washed offsite and returned to the facility at 2511 INTER AVE clean and empty. iii. Fueling of all trucks, including but not limited to vactor trucks, shall be done offsite, b. The City has recorded multiple instances of Illicit Fecal/E. coli discharge originating from the project site from 2022-2023. The source of this illicit discharge is yet unknown; however, the likely sources include a cross connection between the onsite sewer system and the onsite stormwater system, or intermittent violations of the operations and maintenance plans as it pertains to source control. Required mitigation shall include: i. No further illicit discharge of Fecal/E coli from this site shall be permitted. ii. A plug has been installed in pipe #D-13060 connected to catch basin #D-410631 to prevent discharge of contaminated stormwater from the subject site into Deer Creek. This plug shall remain until a clean stormwater sample has been procured. iii. The applicant/owner shall take samples from the onsite stormwater catch basin located immediately upstream of inlet #D4-10087, located in the public ROW of Inter Ave. Specifically, they shall regularly test their onsite catch basin #OWS D4-09922, Catch Basin 2. iv. The testing lab shall be an EPA certified lab. Samples shall be analyzed by multiple tube fermentation (MPN) procedure according to Standard Methods for the Examination of Water and Wastewater, 22nd Edition. Sampling methods shall follow all procedures provided by the testing lab regarding requirements for transport, chain of custody, sample bottle additives, and any and all other requirements for valid test results. v. The applicant/owner shall repeat testing for Fecal/E. coli until the samples produce a Fecal/E. coli reading below 100 either MPN/100ml or CFU/100ml. vi. Civil permit #E-20-0067 shall not be issued until monitoring results, as described in subsection iv.1.a-b of this section, have been fulfilled. The City shall certify that the project proposed for redevelopment under civil permit #E-20-0067, has been properly mitigated and the civil permit can be issued under either of the following circumstances: 1. The source of the elicit Fecal/E. coli discharge has been resolved without changes to the site, the likely source then assumed to be intermittent violations of the operations and maintenance plans (spills from the unwashed vactor trucks contaminating the stormwater catch basins). a. To confirm the illicit discharge has been resolved the owner must provide to the City’s Water Quality Specialist results from samples taken from all stormwater catch basins suspected of contamination, with the samples taken during a rain event. The test samples must be procured and transported to a laboratory certified in this kind of testing, following all applicable procedures referenced in section 2.b.iii, for these tests to be accepted by the City as valid. The test results must demonstrate that the levels of Fecal/E coli are below 100 of either MPN/100ml or CFU/100ml. b. After the City’s Water Quality Specialist has reviewed the owners test results, the City’s Water Quality Specialist will then take their own samples and have these samples tested. If the test results from the City’s samples are confirmed to also be below 100 of either MPN/100ml or CFU/100ml, the City shall certify in writing to the applicant and the Development & Permitting Services Department, that the source of the Fecal/E. coli contamination has been resolved and permit E-20-0067 shall be reviewed with no further action taken regarding this mitigation measure. 2. If the source of the elicit discharge cannot be resolved without physical changes to the site infrastructure, the applicant shall make all necessary changes to the site infrastructure to permanently resolve the stormwater contamination. Under this scenario it is believed that the source of the illicit discharge may be a cross connection between the onsite stormwater system and the onsite sewer system. a. The applicant/owner shall investigate and determine the origin of the illicit Fecal/E. coli readings from Stormwater catch basin #OWS D4-09922, Catch Basin 2. b. Once the origin of the illicit fecal/E. coli discharge has been determined, the applicant shall immediately make all necessary infrastructure changes via any and all City permits as applicable. c. Once necessary changes have been made on site to address the illicit discharge, testing as described in subsection iv.1.a-b of this section shall be performed. d. Once the City’s Stormwater Engineer have received test results demonstrating compliance below 100 of either MPN/100ml or CFU/100ml from both the applicant and the City’s water specialist, then he will confirm in writing to the Development Engineering Manager that the illicit discharge has been resolved. e. The applicant shall make any corresponding changes to their civil permit proposal (Permit #E-20-0067), to show the new infrastructure conditions.
